Job Description

1 Product Clearances

Design search strategies and execute searches for the proposed product concepts, NCE/NBE space, Nutraceutical, and DF formulations ; Design prepare preliminary patent assessment (PPA) reports and identify potential blocks, if any, and propose guidance to the research teams; Design & prepare preliminary FTO reports in view of proposed formulations strategy and provide preliminary recommendations; suggest alternate options; coordinate with research teams and update the team with latest happening in the IP field.

2 Product Ideation/Selection

Design and conduct prior art searches; prepare evaluation reports with strategy around key IP blocks and collaborate with the supervisor; recommend potential non-infringement/invalidity strategy for the relevant patents; periodically advice the cross-functional teams on patent trends to optimize the product portfolio. While achieving the above ensure the needs of the stake holders are understood and aligned.

Propose new IP driven business opportunities in the designated space

3 IP creation & prosecution

Propose preliminary IP Strategy covering various Intellectual Property Rights, given their criticality in the NCE/NBE space, Nutra, and DF space. Design and execute patentability assessment; identify invention hooks and design patent claim strategy; define Target IP Cover and design new experiments for patent filing purposes; prepare patent application drafts; prepare patent filing documentation; analyze and prepare office action response drafts for patent office actions; liaison with Indian patent office/attorney firms and ensure patent prosecution support is provide to realize the desired IP outcomes; prepare invention-assignment documents and follow up with inventors for formal documentation process; Present the findings to the Supervisor and take the guidance as appropriate to ensure the alignment.

4 Licensing

Perform IP due diligence and support in-license/out-license/co-development activities; ensure detailed IP evaluation report is made with all merits and demerits of the IP around the assets; identify business risks (IP) (present and future) and propose preliminary recommendations for discussion and work closely with Business Development/Portfolio teams; support business teams while entering into a licensing agreement; identify opportunities for generating new IP.

While achieving the above ensure the needs of the stake holders are understood and aligned.

5 Competitive Intelligence and customer support

Monitor the competitive landscape and periodically communicate the cross-functional teams on IP activity (including to competitor’s) to optimize the product portfolio; track competitor’s IP activities and work closely with development teams to ensure the alignment with IP; propose new IP creation opportunities that can enhance the product market life by blocking the competition (either Product(+) or Product(-))

6 Indian Patent Portfolio

Managing the filing, prosecution, patent office compliance requirements, pre-grant, and post-grant requirements of all the Indian patent applications/patents; work closely with the supervisor and internal teams to ensure the timely conclusion of the prosecution with favorable outcomes; ensure all IP risks are mitigated (Indian patent prosecution related) in collaboration with the supervisor; keep track of patents/applications that require to be challenged (e.g. Patent opposition) to ensure the IP risk free launch of products;

7 Pre-litigation Support

Develop preliminary arguments and defenses for pre/post grant oppositions in the BRIC territories; Work with counsel to procure opinions, and ensure timely filings

8 Miscellaneous Activities

(a) To guide and review IP activities of the team members.

(b) While achieving the above ensure reporting staff is groomed/trained, create growth opportunities and deliver on the assigned tasks

(c) To manage all publication/ trainee thesis clearances and ensure that the publications/ presentations timelines align with the business strategy.


Qualifications

Education & Experience

M. Pharm in Pharmaceutics/ Industrial pharmacy/ Medicinal chemistry with minimum 12+ years of experience in IP function

LL.B or Indian Patent agent desirable

Business Understanding

Must have broad understanding of the development of pharmaceutical products, regulatory and patent law globally

Patent and regulatory databases in different countries
